These Terms and Conditions apply to quotes / invoices supplied for consultation services by Kidsafe SA at an agreed location.
We use the following term:
- “Kidsafe SA” means Kidsafe South Australia Inc.
- “Client”, “you”, or “your” means your service / organisation or individual (parent / carer).
Quotes
Quotes are estimates based upon the products / accessories trialled by the client and or other party. Quotes are subject to change in the event of product price increases.
Quotes are only valid for 60 days from the date of issue.
Code of conduct
Requires workers and providers who deliver mobility and disability service to:
- Respect for individual rights to freedom of expression, self-determination, and decision-making in accordance with relevant laws and conventions.
- Respect the privacy of people with disability.
- Provide support and services in a safe and competent manner with care and skill.
- Act with integrity, honesty, and transparency.
- Promptly take steps to raise and act on concerns about matters that might have an impact on the quality and safety of supports provided to people with disability.
- Take all reasonable steps to prevent and respond to all forms of violence, exploitation, neglect, and abuse of people with disability.
- Take all reasonable steps to prevent and respond to sexual misconduct.
Product availability
Kidsafe SA does not stock large quantities of products. Sometimes there may be a delay in delivery for any product that is not in stock.
Completion of service agreement
The service agreement will cease once all approved products have been supplied and installed by Kidsafe SA, or Kidsafe SA has been notified by parties involved they no longer wish to proceed. At this stage any applicable consultation fee/s must be paid in full.
Re-trial / 2nd consultations:
Fees for subsequent consultations are applicable as per our service agreement.
Cancellation policy
At our discretion we may invoice for any work or expenses if any consultation is cancelled within 12 hours of the confirmed date and time of the booked service or not attended.
Product/ service satisfaction
If you or the client have any concerns regarding a service or product provided by Kidsafe SA please contact Kidsafe SA directly on 08 7089 8554 or email enquiries@kidsafesa.com.au.
All products supplied have warranties, both express, and implied. It is the client’s responsibility to ensure warranty terms and conditions have been met. The warranty for a product will be voided if it is damaged due to neglect or misuse.
Confidentiality
It is agreed that employees of Kidsafe SA shall not at any time either during the consultation or thereafter, divulge any confidential information about the client to anyone whatsoever without the client’s consent in writing.
Trial products
Policies and procedures are enforced to ensure the security of our equipment. By agreeing to hire Kidsafe SA equipment and products, you agree to follow the procedures, terms and conditions.
- The customer will accept full responsibility of the trial equipment for any damage, loss or disfigurement sustained while in your possession.
- The customer agrees to pay the costs of any required repairs or replacement for the equipment lost or damaged. A piece of equipment is considered to be lost if it is not returned with all components supplied within 3 weeks of due date. An invoice for the replacement cost of lost equipment will be sent if it is not returned within 3 weeks of due date.
- The customer is deemed to be in possession of the product from the point in which they receive the equipment. The equipment will be deemed to have been returned when the equipment has safely arrived to the Kidsafe SA premises.
- The customer is responsible for the return of the equipment by the agreed due date. A late fee will be charged on a daily basis for any late returns. Merely shipping out the equipment before the due date will not be accepted, and the customer must ensure the product is returned on or before the due date to Kidsafe SA premises.
- The trial equipment must be returned in full. Partial return or missing components will not be accepted. The equipment will not be deemed to have been returned until all components are returned.
The customer will not perform any repairs or alterations to the trial equipment.
Extension of equipment trial must be approved by Kidsafe SA staff and additional fees will apply.
Liability
Loss, Theft or Damage
You indemnify Kidsafe SA against all loss, damage, liability, costs and expenses incurred by Kidsafe SA in connection with any loss, theft or damage to the trial equipment(s) occurring as a result of the use of the child car restraint and or harness(s), except to the extent caused by Kidsafe SA.
Personal Injury
You indemnify Kidsafe SA against all loss, damage, liability costs and expenses incurred by Kidsafe SA in connection with any personal injury to or death of any person occurring as a result of the use of the trial equipment(s), except to the extent caused by Kidsafe SA.
You acknowledge that:
- Kidsafe SA has demonstrated how to use the trial equipment or provided instruction manuals for the products hired to you; and
- You have examined and inspected or have had every opportunity to examine and inspect the equipment and you are fully aware of all risks relevant to the trial.
You understand that:
- Any equipment hired to you is on an ‘as is’ basis and Kidsafe SA is not liable if the equipment is not fit for your intended purposes or otherwise not in the condition or state necessary for use by you;
- To the extent permitted by law, all implied warranties, guarantees and representations in connection with the hire of the trial equipment are excluded by Kidsafe SA;
- To the extent permitted by law, the liability of Kidsafe SA for a breach of any such warranties, guarantees and representations or liability which by law cannot be excluded is limited, at Kidsafe SA's option, to the repair of the trial equipment or the cost of having the equipment repaired or resupplying the equipment; and
- Except to the extent of any liability that cannot by law be excluded, the maximum aggregate liability of Kidsafe SA for any liability, loss, damage claim, expense or action whatsoever in connection with the trial of the equipment is limited to the Trial Fee.
